THE VOICE
OF THE
MEDIATION CLIENT
FILM
The Alternative Dispute Resolution Section of the Florida Bar has embarked on a unique project to interview litigants who have recently engaged in mediation to discover what actual parties really think about the mediation process.

In this groundbreaking film, you will hear from diverse parties who recently mediated cases, including plaintiffs, a risk manager, an adjuster with over 40 years of experience, a human resources director, and several in-house attorneys, among others.
These litigants will share, from the client’s perspective, how trial lawyers and mediators are seen by parties engaged in mediation.
This film also reveals how litigators and mediators can speak more effectively to decision makers during mediation.
The film will provide answers to these long-debated questions:
What makes an opposing counsel’s opening statement persuasive?

What is the most effective negotiation strategy during mediation?
What is the best way to prepare clients for mediation?
How are trial lawyers and mediators perceived during mediation?
Is in-person or virtual mediation the better platform for reaching an agreement?
How can mediation be conducted more effectively?
